At Emma’s Cake Castlerea, we are dedicated to providing high-quality, custom-made cakes. We aim to ensure all customers are satisfied, while also being fair to our business. Please read our policy carefully to understand your rights.

1. Refund Policy

As we produce cakes to order, they are custom-made products, and therefore subject to specific refund terms.

Cakes in Production (14 or Fewer Days Before Collection):
Once we are within 14 days of the scheduled collection date, the cake is considered in production. At this stage, significant resources are used (baking, custom decorations, toppers, and third-party items like edible prints).

Refund Terms: If you cancel during this period, 50% of the total amount paid will be retained to cover non-refundable costs such as ingredients and third-party items.

Impact of Cancellations: Due to the custom nature of the order and our allocated time slot, cancellations impact our ability to accept other orders, and we are unable to refund the full amount.

Cancellations with More Than 14 Days Left:
If you cancel your order with more than 14 days before the scheduled collection date, a €5 cancellation fee will apply. Additionally, any non-refundable third-party items already ordered or produced (such as toppers or edible prints) will be charged.

Safety Issues:
In accordance with the Sale of Goods and Supply of Services Act 1980, if the cake is found to be unfit for consumption (e.g., due to contamination or unsafe ingredients), you are entitled to a remedy. This may include a repair, replacement, or full refund at our discretion. Please contact us immediately to discuss any issues.

Any fraudulent claims or deliberate attempts to tamper with or contaminate the cake will be taken seriously and may result in legal action.

Important Note: Minor variations in colour, design, or decoration are to be expected due to the handmade nature of our cakes and do not constitute grounds for a refund.

Flavour Combinations & Custom Requests:
We are happy to accommodate your preferences for flavours and design. However, if a customer insists on a specific combination of flavours or ingredients and is not satisfied with the result, we are not liable for this preference, and no refund will be issued. We strongly recommend discussing your flavour choices with us beforehand to ensure your satisfaction.

2. Return Policy

Due to the nature of custom-made cakes, we do not accept returns. However:

Inspection Upon Collection: Customers are encouraged to inspect the cake at the time of collection. Once the cake has been collected and accepted, no refunds or adjustments will be made after this point.

Post-Collection Responsibility: Once the cake has left our premises, we are not liable for any damage during transport or after collection.

Minor Variations: Due to the handmade nature of custom cakes, minor variations in design, colour, or decoration may occur, which are not considered defects and do not qualify for refunds or returns.

3. Collection Policy

Collection Only: All cakes must be collected from the agreed-upon location at the agreed collection time. We do not offer delivery services.

Timely Collection: It is the customer’s responsibility to ensure timely collection. If a cake is not collected on the scheduled date, no refund will be issued, and the cake may not be stored beyond the collection date.

Customer Responsibility: Once the cake has left our premises, we are not liable for any damage during transport or after collection.
